RENTLAB MOTORBIKE RENTAL AGREEMENT

CONTRACT TERMS – MUTUALLY AGREED

This agreement sets forth the terms and conditions between Rentlab Solutions Co., Ltd. (“the Lessor”) and the Renter (“the Lessee”) pertaining to the temporary use of a motor vehicle (motorbike), as detailed in the rental order. By proceeding with the rental, the Lessee hereby acknowledges and agrees to all provisions set forth below.


1. Permitted Use of Vehicle

The motorbike is provided exclusively for personal transportation and general commuting purposes.
The Lessee shall not:

  • Operate the vehicle for commercial, racing, off-road, or delivery purposes;

  • Sublet, lend, or assign use of the vehicle to any third party;

  • Engage in any activities in violation of Thai law, including traffic, narcotics, or immigration regulations.


2. Liability for Damages and Accidents

The Lessee assumes full responsibility for any and all damages, theft, or loss arising during the rental period, whether caused by negligence, accident, or third-party interaction.
In the event of any physical damage (including but not limited to scratches, cracks, broken lights/mirrors), the Lessee agrees to:

  • Present the motorbike to a Rentlab-authorized repair center on the same day of the incident;

  • Settle the full cost of repair on the spot, as per the official invoice provided by said repair center;

  • Remain financially liable regardless of whether a third party was involved, unless that party accepts and remits payment directly.

Failure to comply may result in immediate contract termination and further legal action under Thai civil and commercial law.


3. Insurance Coverage

RentLab provides mandatory Third-Party Compulsory Insurance (Por Ror Bor) as required under Thai law. This insurance provides limited compensation for bodily injury or death only, in accordance with applicable Thai regulations.

The rental does not include:

  • Personal accident insurance for the Lessee or passengers;

  • Insurance coverage for damage to the rented motorbike;

  • Insurance coverage for damage to third-party vehicles or property;

  • Theft, collision, or comprehensive insurance.

Accordingly, the Lessee accepts full and exclusive financial responsibility for:

  • Any damage to the rented motorbike;

  • Any damage to third-party vehicles or property;

  • Any losses not covered by compulsory insurance.


4. Identification & Deposit Policy

  • No physical deposit, cash hold, or credit card pre-authorization is required.

  • The Lessee is not required to surrender a passport.

  • The Lessee must complete a mandatory online identity verification, including submission of a valid photo ID and a selfie, prior to vehicle pickup.


5. Authorized Use

The Lessee is the sole authorized operator of the vehicle.
Use by any unverified or unauthorized individual shall be considered a material breach of this agreement.


6. Security Obligations and Loss

When parked or unattended, the vehicle must be securely locked using the built-in handlebar locking system.
Keys must be removed from the ignition at all times when not in use.

In case of theft, total loss, or disappearance, the Lessee shall be held liable for full replacement value based on current market price.


7. Repairs and Maintenance

The Lessee may not modify, alter, or repair the motorbike without prior written authorization from Rentlab.
Flat tires or punctures are considered normal use costs and are to be repaired at the Lessee’s own expense.


8. Late Return Penalty

Failure to return the motorbike by the agreed date/time will incur a surcharge of 100 THB per hour, unless prior extension is granted in writing by Rentlab.


9. Rental Extension

The Lessee may request an extension to the rental period, subject to vehicle availability.
Such requests must be submitted and confirmed prior to the expiration of the current rental period.


10. Early Termination by Lessee

There shall be no refund or prorated adjustment for early return of the motorbike.


11. Breach and Enforcement

Should the Lessee breach any clause of this agreement, Rentlab reserves the right to:

  • Immediately terminate the rental without refund;

  • Recover the vehicle without notice;

  • Pursue any and all remedies available under Thai civil and criminal law.

12. Geographic Use Restriction (Motorbikes Under 300cc)

Motorbikes with engine capacity under 300cc are strictly restricted to use within the Bangkok metropolitan area only.

The Lessee is not permitted to ride, transport, or otherwise operate such vehicles outside the Bangkok area under any circumstances.

In the event of a violation of this restriction:

  • Rentlab bears no responsibility for any damage, accident, breakdown, loss, theft, or third-party claim occurring during or as a result of such use;

  • All repairs, recovery, towing, transportation, and associated costs shall be borne entirely by the Lessee, regardless of fault;

  • The Lessee agrees to pay a penalty fee of 5,000 THB for breach of this clause, in addition to all repair or recovery costs.

This penalty does not limit Rentlab’s right to pursue further compensation or legal remedies where applicable.


13. GPS Tracking and Monitoring

The Lessee acknowledges and agrees that the motorbike is equipped with GPS tracking for security, recovery, and compliance purposes.

GPS data may be used by Rentlab to verify vehicle location, route history, usage behavior, and compliance with this agreement, including geographic restrictions.


14. Negligence and Improper Use

Any damage resulting from misuse, overloading, riding in prohibited areas, reckless operation, or operation inconsistent with normal road use shall be deemed Lessee negligence, and full financial liability shall apply.


15. Administrative and Downtime Costs

If the motorbike becomes partially or fully unusable due to damage, breach of contract, or prohibited use, the Lessee agrees to compensate Rentlab for loss of rental income, administrative handling, and operational downtime, calculated on a daily rental basis in addition to repair costs.


16. Governing Law and Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of the Kingdom of Thailand.

Any dispute arising from or in connection with this agreement shall fall under the exclusive jurisdiction of the Thai courts.


17. Acknowledgment and Acceptance

By completing the booking, identity verification, and vehicle pickup process, the Lessee confirms that they have read, understood, and agreed to all terms and conditions set forth in this agreement, including all restrictions, liabilities, penalties, and enforcement provisions.

18. Extension of Rental Period via Messaging Applications

The Lessee may request an extension of the rental period outside the online booking system, including but not limited to communication via WhatsApp, WeChat or LINE, provided that such communication is conducted exclusively through the Lessor’s official contact channels.

Any extension of the rental period shall be considered valid and legally binding only when:

  • the request is made by the Lessee using the same phone number associated with the original booking, and

  • the Lessor provides written confirmation of the new rental dates via the same messaging platform.

Upon written confirmation by the Lessor, the agreed extension shall constitute an addendum to this Agreement and shall be deemed an integral part of the original contract. All original terms and conditions shall remain in full force and effect unless expressly stated otherwise in writing.

Chat records, message timestamps, and confirmation messages may be retained and used as legal evidence in the event of any dispute.

‘Failure to return the vehicle on the newly confirmed date shall be treated as unauthorized possession of the vehicle and may result in penalties, recovery actions, or legal proceedings.

19. Mobile Phone Holder – Use at Own Risk Clause

The Lessor may provide a mobile phone holder or mount attached to the motorbike for the convenience of the Lessee. The Lessee acknowledges that such phone holders are provided without any guarantee as to suitability for any specific mobile phone model, riding conditions, road surface, speed, vibration level, or usage scenario.

The Lessee understands and agrees that:

  • Mobile phone holders may loosen, shift, unscrew, or fail due to vibration, road conditions, improper handling, or incorrect adjustment;

  • The secure installation and correct use of the phone holder is the sole responsibility of the Lessee, including checking tightness before and during use;

  • The Lessor does not insure, warrant, or assume liability for any mobile phone or personal electronic device placed in the holder.

The Lessor shall not be held liable for any damage, loss, malfunction, or destruction of the Lessee’s mobile phone or electronic devices, including damage resulting from holder failure, vibration, road conditions, accidental dropping, or improper use, even if the phone holder is provided by the Lessor.

Any damage to the Lessee’s mobile phone or electronic devices occurring during the rental period shall be borne entirely by the Lessee, and no claim, refund, or compensation may be made against the Lessor.
